Justice Department's No. 3 official steps down

Rachel Brand, the third-highest ranking official at the Justice Department and the first woman to serve as associate attorney general, plans to step down, according to people familiar with her decision.

The Times report cites two sources briefed on the matter.

In a statement, Brand said she is proud of the department's accomplishments during her short time there. But the paper noted that if Trump fired Rosenstein, it would place Brand in Trump's crosshairs as she took on oversight of the investigation.

Rachel Brand is leaving for the top legal job at Walmart, friend and former colleague Jamie Gorelick told The Associated Press Friday. She was appointed to that post by then-President Barack Obama.

After just nine months on the job, Brand had become more and more uneasy with Trump's escalating attacks on the Justice Department and the Federal Bureau of Investigation, which she and other law enforcement professionals feared was beginning to undermine the rule of law, according to sources familiar with her thinking. The memo, which was released publicly last week, said Rosenstein signed off on an application to reauthorize a surveillance warrant on ex-Trump campaign advisor Carter Page.

When Trump was asked by a reporter whether he was then more likely to fire Rosenstein and whether he had confidence in him, Trump replied "you figure that one out".

But the White House denied that there would be any changes made at the Justice Department later that evening.

Trump also has criticised Sessions for recusing himself.

In an op-ed in The Washington Post previous year, Ms. Brand argued that the law "has been valuable and effective in protecting the nation's security" and that law enforcement officers would be "at risk" without it. Congress voted to extend that law, Section 702 of the FISA Amendments Act, last month. Attorney General Jeff Sessions, himself repeatedly criticised by Trump, praised her "critical role in helping us accomplish our goals as a department". The law was reauthorized in January. She was previously President George W. Bush's assistant attorney general for the Office of Legal Policy, which develops and implements the department's significant policy initiatives.

And her departure leaves another vacancy at the Justice Department, which still lacks Senate-confirmed leaders over many of its most important divisions. In her current capacity, she oversaw a number of politically challenging areas of the department, including the civil rights, antitrust and civil divisions.
