Second judge blocks Trump from ending DACA

The Trump administration's plan to end the Deferred Action for Childhood Arrivals program was temporarily blocked by a second federal judge on Tuesday.

President Donald Trump moved past year to end the Deferred Action for Childhood Arrivals (DACA) program, telling Congress to find a legislative fix for "Dreamers" who were plunged into legal limbo by his decision.

The ruling stems from a lawsuit filed by AG Healey and a coalition of 16 other attorneys general in the U.S. District Court for the Eastern District of NY in September 2017 to defend the DACA program. The issue was brought to the judge when several DACA recipients, known as "Dreamers", and 17 attorneys general led by New York AG Eric Schneiderman sued the federal government for the September 5, 2017 decision to end the program. "Based on its review of the record before it, the court concludes that defendants have not done so". Alsup explained that the Department of Homeland Security's "decision to rescind DACA was based on a flawed legal premise".

"The public interest is not served by allowing defendants to proceed with arbitrary and capricious action", he added while issuing a preliminary injunction.

Some media outlets erroneously reported that the ruling would require the Trump administration to accept new applications for DACA.

Amid the legal setback, Senate efforts to find a solution stalled Tuesday as party leaders squabbled over how to start proceedings.

The Justice Department said it maintains that the administration acted "within its lawful authority" in deciding to end DACA and will "vigorously defend this position".

And he said the administration doesn't have to approve any specific DACA applications.
