Trump fails to evade climate change lawsuit filed by 21 youths

President Donald Trump and his administration have been trying to keep a climate change lawsuit out of appeals court in San Francisco. The Court ruled that the Juliana case can proceed toward trial in the U.S. District Court for the District of OR and that the Trump administration had not satisfied the factors necessary for an extraordinary writ of mandamus.

The publication stated that 21 young adults from OR filed a complaint in 2015 that said government policies exacerbated climate change and that global warming violated their rights.

In seeking to overturn that ruling, the government said letting the case proceed could lead to burdensome litigation, and provoke a "constitutional crisis" by pitting courts against Trump and the many other Executive Branch officials named as defendants. When Trump took office, his White House had also sought to end the suit, but the teenagers prevailed.

Noting that the United States is a defendant in almost 20 percent of civil cases filed in federal court, Chief Circuit Judge Sidney R. Thomas wrote that federal rules of procedure anticipate defendants will sometimes face burdensome litigation.

Julia Olson, an attorney for the plaintiffs, said in a statement that the group will seek a trial date for later this year, "where we will put the federal government's unsafe energy system and climate policies on trial".

The group of mostly teenagers in OR alleged in a 2015 complaint that government policies have exacerbated global warming in violation of their rights - and those of future generations - under the U.S. Constitution.

"They allege that the defendants have known for decades that carbon dioxide emissions from the burning of fossil fuels destabilize the climate", according to the latest court decision.

A three-judge panel for the Ninth Circuit shrugged off the government's arguments Wednesday, finding the normal course of litigation would address its concerns.

The Justice Department did not immediately respond to a request for comment. Bloomberg said they utilized a rare procedural maneuver to contend a federal judge overstepped her authority - in 2016, she refused to dismiss this case. They seek various environmental remedies. Olson said that the plaintiffs are seeking a trial for 2018.

Thomas further wrote that "there is enduring value in the orderly administration of litigation by the trial courts, free of needless appellate interference".

The US government just failed to stop a landmark climate lawsuit.
