17 states and 7 cities file lawsuit challenging 2020 Census citizenship questions

Sixteen states and the District of Columbia have joined NY state and city in filing suit Tuesday against President Trump and the Department of Commerce over the decision to include a citizenship question on the 2020 Census. He said it would depress turnout in immigrant-heavy states and mocked U.S. Attorney General Jeff Sessions for saying the question was necessary to enforce the 1965 Voting Rights Act, noting that Sessions has called the act "an intrusive piece of legislation".

But asking all households the question could cost Texas billions of federal dollars and as well as new seats in Congress because some of the state's Latino population will simply "throw it in the trash", when their census form arrives, said Mark Jones, a Rice University political scientist. In 1980, the bureau argued that an immigration question would jeopardize accuracy of the population count. "As state Attorneys General we are committed to making sure every voice is heard, and we believe that every person in America counts".

The suit, as NPR and the Chicago Tribune reports, comes more than a week after California filed a similar lawsuit federal court against Commerce Secretary Wilbur Ross, who oversees the bureau, and Census Bureau officials. Democratic members of New York's congressional delegation said Tuesday that the decision to add a citizenship question was an attack on states, like NY, with high immigrant populations in an attempt to cut their congressional representation and share of federal funding.

As Snopes put it in their explainer on the subject: "It won't be the first time people are required to divulge their citizenship status on a US census form, but it will be the first time since 1950 that everyone is required to do so".

The suit alleges that the Census question "violates the constitutional mandate to conduct an 'actual Enumeration, '" meaning the federal government is required to count all residents, not just citizens. They know exactly what they are doing with this citizenship question.

His connection to the Russian Federation probe runs through Rick Gates , former Trump campaign chair Paul Manafort's deputy. None of the charges so far directly relate to the issue of alleged collusion between the Trump campaign and Moscow.

"Decisions to change questions on the decennial census typically take several years to test, evaluate, and implement", the lawsuit claims, pointing to the Trump administration taking less than four months to add the question.

Introduced by her nickname La Luchadora (The Fighter), Rep. Nydia Velasquez, D-N.Y., referenced Trump's campaign slogan in denouncing the question as a "blatant, racist attempt to 'Make America White'".

A spokesman for the Commerce Department declined to give an on-the-record comment on the lawsuit.

With the start of the 2020 Census less than two years away, preparations for the decennial count of the nation's residents have already begun in Oregon.

Eighteen AG's, six cities and the bipartisan US conference of mayors are all in.
