49ers' Reuben Foster pleads not guilty to felony domestic violence, gun charges

San Francisco 49ers linebacker Reuben Foster pleaded not guilty Tuesday to the three felony charges he faces from a February incident, according to the Santa Clara County (Calif.) District Attorney's Office. The woman flagged down a stranger's auto on Shannon Road and asked the driver to call 911, according to the Santa Clara County district attorney's office.In April, Foster's girlfriend, Elissa Ennis, issued a statement through her attorney, Stephanie Rickard, recanting the allegations and saying she made up the story about Foster punching her repeatedly in an attempt to "trash his career" after Foster tried to break off the relationship.Rickard provided the district attorney video evidence just two weeks ago that the defense says will exonerate Foster.

Although Foster, who is charged with three felonies, is not facing any type of animal cruelty charges, the Sacramento Bee reports that Foster's ex-girlfriend, Elissa Ennis, told police he threw her dog across a room during an argument. She said she fabricated the story of Foster hitting her 10 times because she wanted to ruin his career after their relationship went south.

She even claims to have video evidence that the injuries she sustained were not the result of an altercation with Foster, but from a physical fight with another woman.

A preliminary hearing was set for 11 a.m. CDT May 17. She also complained about her left ear, which turned out to have a ruptured ear drum.

Police found two weapons in Foster's residence. It was found in a bathroom floor loaded with a 30-round magazine and bullet in the chamber, according to the police report.

Ennis claimed that Foster threatened her life should she call authorities.

Santa Clara County deputy district attorney Jim Demertzis and Josh Bentley, Foster's attorney, declined comment after Tuesday's proceedings. Police also have contacted the driver whom Ennis flagged down and who allowed her to call 911, as well as an acquaintance of Ennis' whom she also called from the motorist's cellphone.

Due to the addition of the video evidence, Foster's plea hearing was delayed until May 8.

Foster 's friend stayed with Ennis and him that February 11 night, and claimed he was unaware of any altercation or argument.

"They may seek to impeach what she says on the stand, and say the story she told initially is the stronger of the two stories", Clark said.

Police photographed Ennis' injuries at the scene, recording a swollen lip, scratches and a cut on the back of her neck and a scraped knee.

The 49ers have asked Foster to stay away from the team facility and the ongoing offseason program until his case is resolved or there's a significant development. Despite his missed time, Foster finished second on the team in tackles. The team has said it will cut him if it's proven he hit Ennis, and he still could face at least a six-week National Football League suspension based on its domestic-violence policy. "We try to have a consistent standard, but of course, talent kind of dictates some level of that".
