Trump lawyers to Mueller: Trump can not be forced to testify

President Donald Trump 's legal team has made a broad assertion of executive privilege in a bid to avert a subpoena by the special counsel investigating the president's conduct with respect to Russian Federation, according to a confidential memo obtained by The New York Times.

CBS News chief White House correspondent Major Garrett reported in April that Rudy Giuliani and other members of the president's legal team met with special counsel Mueller that month to discuss a possible interview.

The 20-page letter was a response to repeated requests by Mueller's office asking to interview Trump. Those include whether a president can be forced to answer questions from prosecutors, whether it's possible for a commander in chief to criminally interfere in investigations and whether a president's broad pardon power can be deployed for corrupt purposes. Giuliani said last week that the special counsel probe may be an "entirely illegitimate investigation" and need to be curtailed because, in his estimation, it was based on inappropriately obtained information from an informant and Comey's memos.

The president has repeatedly pointed fingers at Democrats for alleged collusion during the 2016 election-specifically the Democratic National Committee and the Hillary Clinton campaign for their move to pay $9 million through law firm Perkins Coie to fund the now-infamous, and unverified, anti-Trump dossier.

The president's legal team has made clear that it will combat any effort to force the president to give evidence in front of a grand jury.

The special counsel investigation into Russian election interference and any coordination with President Donald Trump's campaign has cost more than $16 million so far.

"Indeed, the President not only has unfettered statutory and Constitutional authority to terminate the FBI Director", the letter reads, "he also has Constitutional authority to direct the Justice Department to open or close an investigation, and, of course, the power to pardon any person before, during, or after an investigation and/or conviction".

"The president did not obstruct justice", the lawyers wrote with respect to Flynn. Critics accused Trump of subverting the rule of law.

"For every one of these things he did, we can write out five reasons why he did it", Giuliani said.

Trump took to Twitter on Sunday to again rage against the FBI and Justice Department, saying he would not have hired Manafort if he had been told Manafort was already under investigation.

"Their argument has antecedents that are legitimate about the president's management of the executive branch", said Wright, who also served as a lawyer for former Vice President Al Gore.

Should Mueller seek to compel Trump's testimony with a subpoena, the arguments advanced in the letter could ultimately form the basis of a courtroom battle that would probably reach the U.S. Supreme Court. "Should have told me!" Mr Trump wrote, referring to former Federal Bureau of Investigation director James Comey.
