ICC 'Undeterred' After US Sanctions Threat

President Donald Trump's national security adviser, John Bolton (C), is reported to be planning to warn the U.S. "will fight back" if the International Criminal Court formally proceeds with opening an investigation into alleged USA war crimes in Afghanistan.

The United States is not a member of the global tribunal that is based in the Netherlands, but American citizens can still face prosecution if they commit war crimes in one of the court's member states, which includes Afghanistan.

Bolton also announced that the USA would shut down the Palestine Liberation Organisation's office in Washington D.C, further deepening a rift with the Palestinian leadership.Bolton said he was delivering these views on behalf of President Trump.

'We have been officially informed that the United States administration will close our embassy in Washington as a punishment for continuing to work with the International Criminal Court against Israeli war crimes, ' Palestinian official Saeb Erekat said.

He said the US will ban the ICC's court judges from the country and enforce sanctions against any nation cooperating with them if they continue to prosecute America or its allies.

The ICC was founded in 2002 to prosecute individuals for global crimes such as genocide, war crimes, crimes against humanity, and the crime of aggression.

The United States may also negotiate more binding bilateral agreements to bar nations from surrendering American citizens to the worldwide court.

The US has threatened sanctions against the International Criminal Court if it goes ahead with prosecutions against Americans.

The court in the Netherlands "has been ineffective, unaccountable, and indeed outright dangerous", Bolton said. More recently, the court said it would investigate Israel's housing projects in the West Bank.

Bolton made the announcement in a speech to the Federalist Society, in Washington, DC, on Monday. And we certainly will not join the ICC.

President Trump ordered the closure of the Palestine Liberation Organization's offices in the nation's capital Monday; citing stalled peace talks with their Israeli counterparts in the ongoing Mideast peace process. The US is among several countries that does not recognise the court's authority.

The US signed the Rome Treaty that established the International Criminal Court in 2002 but never ratified it.

"Israel supports the American actions that are meant to clarify to the Palestinians that their refusal to negotiate and attempts to attack Israel in worldwide forums will not promote peace", he added. "We will not cooperate with the ICC", Bolton said.

Trump has pledged to reach the "deal of the century" on Israeli-Palestinian peace but has declined to commit to a two-state solution, for years the focus of worldwide diplomacy.

Now the pendulum is swinging back with a vengeance, as Bolton labeled the court "illegitimate" and "dead to us".

The move is the latest in a pressure campaign on the Palestinians by the White House, including slashing funding, as it prepares to roll out its long-awaited peace proposal for the Israelis and Palestinians. The national security adviser said it was no coincidence he made his speech on the ICC one day before the anniversary of the September 11, 2001 terror attacks.

The ICC is now considering whether to investigate accusations of abuses against prisoners in Afghanistan from United States soldiers and the Central Intelligence Agency (CIA) between 2003 and 2004.

The administration has said it's trying a new approach to the Israeli-Palestinian conflict after decades of failed peace talks, chipping away at the Palestinians' key issues as it reshapes USA policy.
