Trump accuses judiciary of making US 'unsafe'

The statement came one day after Trump criticized a federal judge who temporarily blocked the administration from denying asylum to people who enter the country illegally. What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them.

The dustup is the first time that Roberts, the Republican-appointed leader of the federal judiciary, has offered even a hint of criticism of Trump, who has several times gone after federal judges who have ruled against him.

U.S. President Donald Trump started his Thanksgiving holiday by renewed his public debate over the independence of the country's judicial system. "It is out of control, has a disgusting reputation, is overturned more than any Circuit in the Country", he said in his opening Twitter salvo of the day.

The chief justice spoke out broadly about judicial independence in October after the tumultuous Kavanaugh hearings. As far as "numbers" goes, its rate of overturned cases - meaning, cases subsequently flipped by the U.S. Supreme Court - is in fact higher than the median for district court circuits (79 percent compared to a median of 70 percent), but there are two other circuits with higher rates.

But on the question of how it actually works, though, the president is more correct than Roberts - up to a point.

In 1992, federal judges in California issued a slew of appeals trying to stop that state's first execution in more than a decade until the Supreme Court ordered judges from the 9th to stop presenting appeals and double murderer Robert Alton Harris was executed in San Quentin's gas chamber.

The US constitution tasks members of the federal judiciary with determining whether or not actions from Congress or the executive branch comply with the constitution. Surprisingly, given Roberts' customary reticence to engage in political feuds, the Chief Justice responded.

In the last term, the Supreme Court overturned 100 per cent of the decisions of the 1st Circuit in Boston, the 3rd Circuit in Philadelphia and the 6th Circuit in Cincinnati.

Dinesh D'Souza, the conservative author and filmmaker convicted of campaign finance violations and pardoned by Trump, said in a tweet that judges nominated by Democrats "vote the leftist line".

Many phrases might describe Roberts' 13 years as chief justice since he was appointed by George W Bush, but "hot-headed" is not among them. "Ultimately, I think this sort of statement will backfire", Josh Blackman, a South Texas College of Law professor told The New York Times. "The 9th Circuit, everybody knows that it's totally out of control".

Trump was frustrated earlier this week that a federal judge blocked the administration's attempt to deny asylum to anyone who enters the US illegally.

Supreme Court Justice Ruth Bader Ginsburg also several times has made derogatory comments about Trump. But rationality has never been Donald Trump's strong suit when it comes to dealing with the judiciary.
