Mr Trump threatened again, without providing specifics on where the funding would originate, to declare a national emergency as an alternative way to build the wall, depending on the outcome of talks in the coming days.

Trump skipped a planned trip to Florida to stay in the USA capital during the Christmas and New Year's holiday after large chunks of the federal government were shuttered on December 22.

Later on CNN, however, Smith said that declaring an emergency would be "horrible policy" and a "terrible idea", and that the president would be challenged in court if he sought to build the wall without congressional authorization.

Trump directed the White House budget office to take steps to mitigate the effects of the shutdown, including ensuring tax refunds are delivered, Pence told reporters.

Smith said declaring a national emergency would be "wide open to court challenges", adding that using the military to build the wall would amount to "a awful use of Department of Defense dollars".
