U.S.'s Pompeo says Huawei is an 'instrument of Chinese government'

U.S.'s Pompeo says Huawei is an 'instrument of Chinese government'

In August 2018, in the 2019 National Defense Authorization Act (NDAA), the US Congress prohibited US government agencies from contracting with Huawei or with companies that use Huawei equipment.

Chinese state media on Wednesday suggested that Beijing could fight back in the trade war by cutting exports of rare earths to the United States, depriving US companies of a key material to make everything from smartphones to televisions and cameras.

"This decision threatens to harm our customers in over 170 countries, including more than three billion consumers who use Huawei products and services around the world", he noted.

"They provide a false sense of security, and distract attention from the real challenges we face", said Song Liuping, Huawei's chief legal officer,at a press conference on Wednesday. In response to such accusations and efforts of the Trump Administration, Song Liuping responds, "Politicians in the USA are using the strengths of an entire nation to come after a private company". "This is not normal. Nearly never seen in history".

USA lawmakers included the provision in the defense funding bill previous year because of what they allege are ties between Huawei and the Chinese government, and security concerns that arise from that relationship.

"There is no gun, no smoke, only speculation", he said, accusing the us of setting a "dangerous precedent". "Only speculation", Song said in a statement.

Huawei is fighting the 2019 National Defense Authorization Act, which authorizes the defense secretary to ban companies from doing business with U.S. firms and federal agencies deemed to be security threats. Huawei has repeatedly rebuffed the claims. Google said it would continue to support existing Huawei smartphones, but future devices won't carry its flagship apps and services, including maps, Gmail and search - a change that will likely make Huawei phones less appealing.

Head of corporate communications Vincent Pang said the company's data shows that allowing Huawei to participate in the U.S. market would save telecoms operators there US$20 billion (S$27.6 billion) over the next four years in the construction of their networks.

In late 2015, then struggling Oi S.A., Telemar's parent company, dispatched an executive team to China to seal a deal with the CDB for $1.2 billion in even cheaper loans - half to buy Huawei gear, and half to refinance debt - with its original loan still on Oi's books.

"If it's the case, that the Chinese Communist Party wanted to get information from technology that was in the possession of Huawei, it is nearly certainly the case that Huawei would provide that to them", Pompeo said.

Huawei filed a lawsuit against the federal government in March arguing the NDAA ban is an unconstitutional "bill of attainder" that targets an individual or corporation for punishment without due process. This is a motion that asks the judge to rule on the legal merits in the case prior to the discovery phase, when the two parties get to demand documents from one another to help them build their cases. Pressed by questions about Google services, Wang reiterated that already marketed smartphones will continue to be supported, but at the current state of affairs, it can not be said that Huawei P30 and P30 Pro will receive Android Q.

Earlier this month, President Trump passed an executive order stopping USA corporations from buying telecoms equipment from companies classed as national security risks.

The presiding judge has scheduled motions through September 10 so Schwinn said it was unlikely the case would be dismissed before then.

"That's the threat that President Trump sees from Huawei", he said, asserting that the U.S. is telling the same to other countries.
